Chapter 13 Fees Explained By Rockdale Bankruptcy Lawyer

07/31/11

There are different charges for Chapter 13 from one attorney’s office to another.  Below is just an example of one such office.  In 90% of the cases, I see a $650 down payment to start the case.  Now of that $650, the client has provided $274 that goes to the court as the filing fee.  The remaining $376 of the $650 is a payment of attorneys fees which over the life of the case amounts to $3500.  That is the flat fee that the judges have approved that most of the Chapter 13 bankruptcy attorneys charge.  So you are not going to have a lot of price shopping at all on Chapter 13 cases like you will on Chapter 7 because everyone is pretty much doing a flat fee of $3500.  The ones that aren’t doing the $3500 are doing fee billing by the hour and are constantly having to come into court to get their fees approved.  It’s a more difficult method of getting paid.  Thus, most attorneys opt for the flat fee, model retention agreement approach.
