12. The estate's interest, if any, in the claims and causes of action against Coastal Energy, Inc., Clint Land, and Rick Smith. Case No. 1:19-CV002040 (the "Coastal Energy Claim"), for breach of contract, fraud, unjust enrichment, tortious interference with business relations related to a contractual relationship pertaining to the sale and delivery of propane gas. A counterclaim in the amount of $6 million has been filed against the Plaintiffs which asserts claims relating to propane gas supplied but for which payment was not made. The case is pending in the U.S. District Court for the Northern District of Ohio. Motions for summary judgment were filed by the Plaintiffs and the Defendants prior to the bankruptcy filing. Under applicable law, the claims of the Seller became property of the estate. Judge J. Philip Calabrese entered an order staying the case.
