Sale of 1/9th interest in the said real property, to-wit:

ALL that certain tract or parcel of real estate with all improvements thereon and appurtenances and rights of way thereunto belonging, situate and being on the waters of Mira Fork and Greasy Creeks in the Indian Valley Magisterial District of Floyd County, Virginia, containing approximately 111-3/4 acres, more or less, this nonetheless being a conveyance in gross by the boundary and not by the acre, and

LESS AND EXCEPT, that certain tract containing 1.000 acre, more or less, acquired from Gorden Quesenberry, et als., to Trustees for the Thomas Quesenberry Cemetery by Deed dated July 20, 1980, said Deed of record in the
Clerk’s Office of the Circuit Court of Floyd County, Virginia in Deed Book 134, Page 222, as shown on that certain plat of survey prepared by John D. Lewis, L.S., dated November 10, 2015 and November 25, 2015, designated as Job No. 178-15, said plat to be recorded in the aforesaid Clerk’s Office, and

SUBJECT TO a perpetual 50' right of way from State Secondary Route No. 622 conveyed to Ida Q. Phillips, widow, et als, by Deed dated December 19,1996, from Squire L. Searcy, et ux, said Deed of record in the aforesaid Clerk’s Office as Instrument No. 960002303, and being more particularly described in said Deed, and

SUBJECT To a non-exclusive 30' right of way for the ingress and egress to said 1.000 acre cemetery as shown on said survey, with a RESERVATION to use existing path through said 1.000 acre cemetery to access said larger tract so long as said use does not affect use of the cemetery, and

BEING all the same real estate conveyed to Ida Q. Phillips, et. als., by Deed dated November 27, 1995, from Dura Quesenberry, said Deed of record in the aforesaid Clerk’s Office as Instrument No. 950001978.
