ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 87 of the 13th Land District of Habersham County, Georgia, designated as Lot 38, Phase Four, Block C, of The Highlands Subdivision, containing 5.18 acres, more or less, as shown on a plat of survey prepared for The Highlands, Phase Four, Block C, by Samuel L. Duvall, R.S., under date of October 13,2000, last revised October 23,2001, a copy of said plat being of record in the Office of the Clerk of the Superior Court of Habersham County, Georgia In Plat Book 51, Page 72, to which said plat and the record thereof reference is hereby made for a more complete description. TOGETHER WITH a nonexclusive easement for ingress and egress via the course of exiting subdivision roads shown on the plat referred to above. NOTE: The above described property is conveyed subject to Protective Covenants imposed by an instrument dated November 8, 2006 recorded in the Office of the Clerk of the Su porior Court of Habersham County, Georgia in Deod Book 779, Pago 861. This being that same property conveyed to David F. Develdor and Linda D. Develder from David F. Develder via Warranty Deed with Right of Survivorship dated October 4, 2007 and recorded in Deed Bonk 825, Page 608, Habersham County, Georgia records.
