Real Properties and Related Oil and Gas Interest in West Virginia

Sale of four parcels of real estate in Marshall County, West Virginia and one parcel in Ohio County, West Virginia, describe as below:

1. 38.769 acre Parcel Marshall Co.: A parcel consisting of 41.8 acres was conveyed to Daniel McFarland by deed dated 8/3/93 and recorded in Deed Book 574 at page 1. There was an out conveyance of 3.071 acres to Brian McFarland and his wife, Vicki McFarland, which was recorded in Deed Book 603 at page 415. The current holding of the Bankruptcy Estate is therefore 41.8 - 3.071 or 38.769 acres.
2. 11.62 acre Parcel Marshall Co.: A parcel consisting of 98.94 acres was conveyed to Daniel McFarland, his two brothers, Donald and Gerald by deed dated 8/24/93 and recorded in Deed Book 574 at page 194. There was an out conveyance of 87.32 acres recorded in Deed Book 594 at page 254 and by corrected deed at 601 at page 183. There was a straw conveyance by which the remaining 11.62 acres were transferred to Daniel McFarland. The deed to the straw party is at Deed Book 595 at page 153, and the deed from the straw party to Daniel McFarland is at Deed Book 595 at page 156. The current holding of the Bankruptcy Estate is therefore 11.62 acres.
3. 11.87 acre Parcel Marshall Co.: A parcel containing 11.87 acres was conveyed to Daniel and Vicki McFarland by a deed dated 11/27/01 and recorded in Deed Book 624 at page 196. The current holding of the Bankruptcy Estate is therefore 11.87 acres.
4. 2.075 acre Parcel (a one half interest only) Marshall Co.: A parcel containing 2.075 acres was conveyed to Daniel and Vicki McFarland by deed dated 5/23/05 and recorded at Deed Book 645 at page 395. This property was transferred to Daniel and Bryan McFarland by deed recorded in Deed Book 648 at page 141. The current holding of the Bankruptcy Estate is a onehalf interest in 2.075 acres.
5. 2.075 acre Parcel Ohio Co.: A parcel containing 2.075 acres was conveyed to Daniel and Vicki McFarland by deed dated 5/23/05 and recorded at Deed Book 645 at page 395. This property was transferred to Daniel and Bryan McFarland by deed recorded in Deed Book 648 at page 141 in Ohio County.
