Commercial Lease and Business Interest for Sale

Sale of Commercial Lease and Business Interest, described as below:

• The Estate includes the a one-hundred percent (100%) interest in an entity named Fresh Approach II, LLC (the “Fresh Approach Membership Interest”). Fresh Approach II, LLC, in turn, operates the “Fresh Approach Market” (“Fresh Approach Market”) on Brackett Street in Portland, Maine;
• The Estate includes the commercial lease (the “Commercial Lease”) for Fresh Approach’s location on Brackett Street by and between Youth In Action, Incorporated, as landlord, and Brackett Street Partners, as tenant. According to the signature page on the Commercial Lease, the individual debtors – Chester Knights and Peggy Knights – are the two general partners of Brackett Street Partners. The Commercial Lease is for an initial five (5) year term, commencing January 1, 2018, with a second five (5) year tenant option. Given Fresh Approach’s location in Portland’s West End neighborhood and the length of the potential term of the Commercial Lease, the Trustee believes the Commercial Lease, along with the Fresh Approach Membership Interest, could have value for the Estate.
