Sale of a portfolio of Borrower Notes, Borrower Deeds of Trust, and the Seller claims and rights against the Borrowers and the Properties. was engaged in the business of originating and then holding and servicing loans to subprime third party borrowers, secured by deeds of trust against the borrowers’ properties in the Dallas—Fort Worth area. These third party borrowers (collectively, the “Borrowers”) borrowed funds from the ATLAS FINANCIAL MORTGAGE, INC pursuant to numerous promissory notes of varying amounts, terms, and interest rates (collectively, the “Borrower Notes”). To secure their obligations under the Borrower Notes, the Borrowers executed deeds of trust in favor of the Company (collectively, the “Borrower Deeds of Trust”), which the Company thereafter recorded, thereby perfecting first priority liens against the Borrowers’ underlying properties (collectively, the “Borrower Properties”)
