Judgment, Lawsuit and Related Assets for Sale

Sale of assets of First Capital Retail, LLC (the “Seller”), which include:

• That certain Judgment entered April 10, 2020, obtained by Seller against IAC Capital Source Funding LLC, et al in Adversary Proceeding #19-02116-E, related to this Bankruptcy Case, in the amount of $32,622.22;
• All of the Estate’s rights to participate in a settlement of a class action lawsuit, entitled In re Payment Card Interchange Fee and Merchant Discount Antitrust Litigation, MDL 1720 (MKB) (JO), bearing a claim confirmation code of 06YAFLEC for the claim filed on October 23, 2020; and
• All other assets of the Estate, other than the cash assets, that presently exist, and those that will be generated, after the Trustee’s / Seller’s administration of the assets of this Estate, which administration will be concluded following consummation of the sale proposed herein.
