Earth Borrow Material

Sale of Seller's right, title and interest in the fill dirt material as set forth in the Borrow Material Agreement, described as:

Winchester Partners, L.L.C. do hereby permit Reed Contracting Services. Inc. to enter onto said property for the removal of earth borrow material for construction of Alabama Department of Transportation Project Number NHF-0002 (564) at the rate of $21.00 per load. Pit area will be approximately five (5) acres in size, Material will be removed by excavating 5' to 7' below existing ground and it is agreed that said pit will be left in that manner upon completion. It is agreed that Reed contracting Services, Inc. will not be required to perform any remediation of the borrow pit Reed Contacting Services, Inc. will be acquiring the ADEM permit for this site, and at the completion of our excavation and removal of earth borrow material die ADEM permit will be transferred to another party within 30 calendar days. Payments are to be made monthly to owner.
