Claims for Sale

Sale of claims of the seller against the Attorney Defendants and Lawyers Mutual as insurer for Lawyers Mutual. The seller, along with Kristopher Hoots, was a plaintiff in certain litigation filed in Forsyth County, case number 16 CVS 4860. That litigation made certain claims regarding alleged failures on the part of Matthew Bryant and his firm, Hendrick, Bryant, Nerhood, Sanders and Otis, LLP, hereinafter referred to as “Attorney Defendants”. Lawyers Mutual would further seek for the order to designate these funds to be paid on the general unsecured claims of the Internal Revenue Service and BB&T, such that their claims are guaranteed to be paid in full. The Bankruptcy Estate already has collected $15,152.50 in funds on hand, but it is not clear what administrative costs may be payable from those funds. By approving this purchase, these two general unsecured creditors would be assured of full payment.
