Sale of FRAUDULENT CONVEYANCE ACTION describe as: On January 8, 2015, (the “Petition Date”), the Debtors commenced a case under Chapter 7 of Title 11 of the United States Code (the “Bankruptcy Code”) in the Bankruptcy Court in and for the Southern District of California, Case No. 15-00074-LT7. Christopher R. Barclay was appointed, and is the duly authorized representative of the Estate pursuant to Section 704 of the Bankruptcy Code. At the 341(a) the Debtors testified that they had transferred real property located at 1747-A Regency Way, Chula Vista, CA (“Real Property”) to Mrs. Moneda’s sister, Gracia Dones. The Trustee reviewed the transfer and concluded that the transfer of the Real Property to Ms. Dones was avoidable as a fraudulent conveyance (“Avoidance Claim”). He further reviewed the documents and determined that the value that could be obtained by avoiding the transfer was approximately $7,500 based on liens,
