Cause of Action for Auction

Auction Sale of interest in any and all causes of action under state common or statutory law or federal law which could have been brought by the seller, including but not limited to all causes of action which could have been brought by the seller under 11 U.S.C. § 544(b), as well as any and all causes of action under state law including fraudulent conveyance claims for actual or constructive fraud (Texas Business & Commerce Code § 24.001 et seq.), breach of fiduciary duty and/or unjust enrichment, and fraudulent conveyances and fraudulent transfers under state and federal law, excluding any causes of action under 11 U.S.C. §§ 547 and 548.
