The sale assets includes: certain real and personal property of the Seller generally located at 68 Garrison Road on Bailey’s Island, Harpswell, Cumberland County, Maine, on which Cook’s Restaurant (the “Restaurant”). The existing Cook’s Restaurant parcel generally located to the west and north of the land identified as the “Parcel to be conveyed” (a/k/a the Wharf Parcel) which Wharf Parcel shall be retained by Seller, together with all improvements and fixtures thereon and all rights, privileges,easements and appurtenances thereto owned by Seller, including without limitation, all air rights, water rights, rights-of-way or other interests in, on, under or to any land, highway, alley, street or rights-ofway abutting or adjoining said parcel, rights in and to the flats lying between high and low water mark (if applicable), and any and all real property and rights described in or associated with the property. The land is a portion of the parcel described in that certain quitclaim deed (the “Deed”) from Charles M. Cook to Norman C. Parent dated May 20, 1987 recorded in the Cumberland County Registry of Deeds in Book 7777, page 241 (said portion being conveyed as the Restaurant Parcel being the “Premises” herein).
