Assets of Bar and Restaurant Business

The Debtor owns and operates a bar and restaurant business, including the following assets: (a) furniture, fixtures and equipment (“FF&E”); (b) the lease of its business premises commonly referred to as 1356 Fischer Boulevard, Toms River, New Jersey 08753 (“Premises Lease”); (c) a State of New Jersey Class “C” Plenary Retail Consumption Liquor License No. 1507-33-004-004, issued by the Township of Toms River, County of Ocean, New Jersey (“Toms River”), hereinafter referred to as the "License"; (d) a franchise agreement between Seller as franchisee and Boston Pizza Restaurants, L.P. (“Boston’s”) as franchisor, effective May 30, 2008 (the “Franchise Agreement”); (e) a certain sewer easement (“Sewer Easement”); (f) a certain parking easement (“Parking Easement”); and (g) food and beverage inventory (“Inventory”) (the FF&E, the Premises Lease, the License, the Franchise Agreement, the Sewer Easement, the Parking Easement and the Inventory are hereinafter referred to collectively as the “Assets”)
