This is the case of Mr. Williams.  Mr. Williams lives in Zion, Illinois, which is in Lake County, Illinois.  He did a Chapter 7 bankruptcy 11 years ago, so he qualifies again.  It’s been over eight years and a day.  He’s not a homeowner.  He’s currently renting in Waukegan, Illinois, and that’s a yearly lease expiring in October.  He’s got a 2000 Mazda, which is financed by a credit union, and there is no equity in that vehicle.  And the same thing applies with a 1996 Harley-Davidson.  They’re both financed together on one loan through the credit union.  He is married.  He has no minor children.  He’s not working, but his spouse is working, so we look at the total household income for the family, and it’s about $2,500.00 per month. 

He has at least that in expenses.  $700.00 for rent, $500.00 for food, $244.00 for transportation, $115.00 for health insurance, and $380.00 for the auto and motorcycle payment loans, so there is no available money per month.  Chapter 7 would be permitted in this case.  He did sell or transfer real estate in the last several years, but it was a short sale, so there were no proceeds to him.  There are no co-debtors, there are no student loans, and there is no income tax debt.  We’re basically talking about credit card debt, and Chapter 7 would work in this case.
