Will I Lose My Job If I File Bankruptcy?

02/26/11

You will not lose your home if you file a bankruptcy case. It is Federal law that allows you to file bankruptcy to handle your financial matters. I sometimes hear about a person whose employer has threatened to terminate someone for filing bankruptcy. The truth is that you have the right to file, cannot be discriminated against for filing and should not fear employer backlash for filing.

There are some financial jobs or positions that would prefer to have someone who has never filed for bankruptcy. However, the mere filing, in and of itself, should not be used as a means to not hire. Further, in most cases, the employer will benefit by having an employee who is not working under the stress of overwhelming debt. It is hard to be at your best when your mind is on your financial situation. Employers would rather not seen or hear the bill collectors calling you at your job. Lastly, you will sleep better at night and be more comfortable at your job. All of these factors will lead to a more productive employee. Any employer would want that of its employees.

If you feel that you are being discriminated against due to your bankruptcy filing, be sure to contact your bankruptcy lawyer immediately.
