10/20/11

Ms. Panes, is divorced. She lives inWaukegan,IL in Lake County. She has one child.  She is renting an apartment that has a yearly lease.  At the moment she has one auto with a lien on it that she is current on it and just got a new engine.  Her other auto was totaled in the year 2007, so she will has an auto deficiency that can be discharged in a chapter 7.

Property and assets, no checking or savings account.  She does have a term life insurance policy and a 401k which is ERISA Qualified.  She has been employed as a packer for about 3 years. She gets a salary and child support for the child.  Her monthly expenses are:  rent and utilities at about $670, food, clothing, laundry, cleaning and medical/dental out of pocket expenses are about $505, gasoline, tolls, mass transit, automobile insurance is about $379, child care, auto payment & rent a center is about $659.  Debtor is presently getting garnished at the moment from one of her credit cards. Her credit cards are at about $8,000 and medical bills at about $1,500.

I would strongly suggest a Chapter 7 bankruptcy filing based upon the facts of this case.
