Wadsworth Bankruptcy Lawyer On Choosing The Right Attorney

09/20/11

Choosing a bankruptcy attorney to help you with either Chapter 7 or Chapter 13 is critical to the success of your case.  Make sure you have hired an attorney who handles Chapter 7 and Chapter 13 bankruptcy cases on a regular basis.  The law is fraught with pitfalls and roadblocks and things that can trip up a debtor.  Do not put your case in the hands of someone who does not have the experience, the knowhow, the intelligence and the credibility to effectively administer your case through the court system.  I have seen many cases that have blown up by people going to other attorneys who did know how to handle cases.  In those cases we re-file the cases and we do it properly.  However the debtor was injured in the sense that they had to go through it twice because the attorney that they hired the first time did not have the wherewithal to prosecute the case thoroughly.  The bankruptcy code has several deadlines, it has several prerequisites that need to be done before certain things can happen and an attorney must stay on top of the current changes to the law and must help the debtor to understand that these deadlines are important, these prerequisites are mandatory and if you fail in any one or two areas of your case your case can easily be dismissed by the court or creditor.
