Speaking Event at the Association of Foreclosure Defense Attorneys
Last night I had the opportunity to address many members of the Association of Foreclosure Defense Attorneys. The group is an excellent assembly of lawyers who are fighting on behalf of homeowners and against the actions of lenders. The group had several great questions concerning the intersection between foreclosure defense and bankruptcy. What I provided was a framework as to how to spot bankruptcy issues related to foreclosure. It basically involves determining what the goals and objectives are of the client and then factoring in the viability of a successful reorganization case under Chapter 13 bankruptcy.
If the homeowner does not have the ability to make current mortgage payments as well as paying something towards the arrearage, then Chapter 13 is not a good option. If the homeowner simply cannot afford the home and wants to avoid any potential deficiency judgment, then Chapter 7 is likely the best option. There are qualifications for each chapter and each case involves a thorough income and expense analysis before a conclusion can be reached.
