Richton Park Bankruptcy Lawyer Stops Creditor Calls

An important issue that the attorney will discuss with the client at the free consultation is the issue of creditor phone calls.  Now for many people, getting phone calls by creditors, especially harassing phone calls, is one of the main reasons why they consider filing bankruptcy in the first place.  So this is a very important topic for a lot of our clients.  I’ve heard stories of clients being called at work, of creditors calling neighbors being called, clients being called, at 1:00 AM in the morning and other obscene hours.   When they hire us we advise the client that they should tell the creditors that they’ve hired our office, give them our phone number, and that’s all the information they need to give.  A lot of times some of the creditors will attempt to talk to the client afterwards, try to get them to settle, some of them will become overly nice, some of them will harass the client. When the creditor calls the client, we advise the client on how to respond. They should tell the creditor that they hired David Siegel’s office for bankruptcy, give the creditor our phone number and if the creditor continues talking, just hang up on them.
It is important though, for the client to let the creditor know for the first time that the client has hired us for bankruptcy. The creditor will call our office up and one of the staff members will simply tell the creditor that, “Yes, John Doe has retained us for a Chapter 7 bankruptcy.  The case is not yet filed.”  In most cases after the creditor knows about this, most of the time they will stop calling the debtor.  And this is obvious because they realize that they’re not going to get any money out of this client.  They want to move on to somebody that they can get money out of.  A few times creditors do still call and harass the client even after we let them know that they’ve hired us.  The only way you can guarantee to stop these phone calls once and for all, is to actually file the case.
