 One of the keys to being a successful bankruptcy attorney is providing exceptional advice to bankruptcy clients so that their case runs smoothly.  To have a case run smoothly, a lot of – a lot of things have to line up in you and your attorney’s favor.  First of all, you have to have a petition that’s properly prepared, where the trustee can look at everything and realize that there are no significant assets to be administered. 

Number two, to have a case run smoothly, you as the debtor want to be aware of the different facets of the case.  You want to be aware of what’s going to happen next and you want to make sure that you are telling your attorney everything that he or she needs to know to process your case effectively.  There are certain timelines that a debtor must comply with to have a case run smoothly, the first of which is the debtor must take a credit counseling session within 180 days of filing the bankruptcy case.  Now, this may sound like a routine, simple requirement, but keep this in mind.  If you go see an attorney and that attorney advises you about the credit counseling and you take that credit counseling right away and then you decide not to move quickly with your case, you’re going to wind up having to take the credit counseling session again if you don’t file within 180 days. 

At my firm, what I recommend is you take the credit counseling session just prior to being paid in full with the attorney and just prior to your case being filed.  There’s nothing worse than having a client have to retake the credit counseling session and pay another expense to a credit counseling agency just to be able to file the Chapter 7 bankruptcy.
