What happens after I file? The progression is something like this. Within 30 to 45 days after the filing, you have to attend what is known as a meeting of creditors, or otherwise known as a Section 341 meeting, so-called after the section in the bankruptcy code which mandates the appearance by the debtor at the meeting of creditors.
You also have to take the debtor education course. You have to take that within 45 days of the date of the 341 meeting. So you can get a jump on it by doing it after you file. You will need your case number in order to conclude the course.
After the 341 meeting, unless the trustee requests any further information, you’re essentially done. There’s a 60 day period called the deadline to determine dischargeability and particular debts and/or discharge. This is a mini statute of limitations that gives creditors the right to pursue their rights in bankruptcy court for the purpose of having their debts either declared to be non-dischargeable or to have your discharge either barred or vacated.
Most cases do not have such actions. In less than 5 percent of all cases is there any kind of action under section 523 or 727. Therefore, most cases will end debtor involvement after the 341 meeting. Once that 60 day period expires, you can begin to look for your discharge in the mail.
