Hazel Crest Bankruptcy Lawyer On Filing Requirements

09/21/11

As far as requirements that go along with filing bankruptcy, there is also a two hour financial management requirement, where a debtor must complete a two hour financial management class prior to the case being discharged, but it must be taken after the case is filed.  Here we have another timing situation.  You do not want to take the two hour financial management class before your case is filed.  If you do take the two hour financial management class before your case is filed, you will have to take it again, because the law says you must take the two hour financial management class after the case is filed, but prior to discharge.

In certain situations, the debtor will not take the two hour financial management class at all.  In those cases, the bankruptcy case will close without a discharge and the debtor will not receive a discharge of the debts.  What this means is that creditors are free to pursue the debtor once again, because the case never went through to finality, simply because the debtor failed to timely take the two hour financial management class.

An experienced bankruptcy attorney will make sure that you are aware of when, how to take that class and will keep on you until you’ve taken that class, because the attorney knows the end result if you don’t take the class is that your case will close without a discharge.  These are things that come with experience.  When to advise a client to take the pre-filing credit counseling session and when to advise the client to take the two hour financial management class after the case is filed.
