Fox Lake Bankruptcy Attorney Can Assist If Creditors Continue To Con...

As a Fox Lake bankruptcy attorney, I advise my clients that no creditors should be contacting you after your Chapter 7 bankruptcy case is over.  There is something called an Automatic Stay and discharge injunction which prevents creditors from contacting you once your case is over.  What I recommend is that you send that creditor a copy of your discharge letter or give them my name and number or contact me so that I can contact them.

Believe me; a creditor does not want to be collecting upon your debt on a discharged Chapter 7 bankruptcy case.  Not only are they violating the bankruptcy laws but they can be sanctioned by the Bankruptcy Court.  Usually, if a creditor is contacting one of my clients after the bankruptcy cases filed, it’s from a transfer of debt or a transfer of collection efforts.  What I mean by that is the one particular creditor gives the right to another person to collect on the debt and that new person is not made aware of the bankruptcy filing.

Once your bankruptcy case is filed and gone to discharge, creditors will not want to contact you because they will be filing federal law and subjecting themselves to a potential sanction in the Bankruptcy Court.
