Downers Grove Bankruptcy Lawyer On Who Contacts Creditors

09/20/11

Who notifies the creditors and bill collectors about the bankruptcy filing?  Part of the reason the attorneys need all the correct addresses, complete and correct addresses, is because upon filing the bankruptcy petition and schedules, the bankruptcy court uses those addresses to send notice not only to the creditors that you filed, but to give them information pertinent to the case, such as the date of the meeting of creditors, deadlines that involve filing proofs of claim or complaints that determine discharge or dischargeability and other pertinent information that the creditor is going to need.  So initially the contact is made by the bankruptcy court; however, there are instances where a creditor does not receive the notice from the court and it may turn out that both debtor’s counsel and/or the debtor will need to provide that information.  But initially the contact is supposed to be made by the bankruptcy court.
