Cicero Bankruptcy Lawyer Tells Of Court Date Timeline

Once the bankruptcy case is filed, the court will set a date approximately four to six weeks after the case is filed.   The client will shortly receive their court date letter from the law firm and one from the clerk of the bankruptcy court.  One question the clients often have is “When will my creditors know that I filed for a bankruptcy?”  The bankruptcy court will inform the creditors in writing for Chapter 7 cases.  The bankruptcy court will send out notices which are B9A forms to the client and to all the creditors listed in the bankruptcy, informing them about the bankruptcy.  Once the creditor knows about the bankruptcy, they cannot contact the client.  And it also stops any kind of garnishments against the client and law suits against the client. 
So now the case is filed.  The clients know their court date, and we send out the court date letter with information of what they need for the creditors meeting or to use bankruptcy terminology, the 341 meeting.
Along with the court date, we also send a DVD.  This DVD takes the place of their second counseling course.  This class is called a “personal financial management instructional course” or PFMI.  Like the credit counseling class, the PFMI is also required by the bankruptcy code.  There is no way around this requirement.  One thing that we do that’s different than any other attorneys that I know of, is we give our clients a free DVD as part of our services that they can watch at home.  If they actually watch the DVD and fill out a form that shows that they actually watched the DVD, the requirement will be complete.  We usually ask them to give it back to us at their meeting of the creditors or court date.  Now the personal financial management course is basically about making good financial decisions.  We want to make sure that our clients have a greater understanding of finances and credit then what they had coming into the case.
