Channahon Bankruptcy Attorney Describes The In-Take Questionnaire
Everyone who comes in for a bankruptcy, whether it is 7 or 13, they are going to fill out a bankruptcy questionnaire to the best of their ability. They can usually stop after page 9 because the remaining pages are just debts. And if they are coming in with their stack of bills, there is no reason for them to be a Scribner and write it all out. But the first eight or nine pages, we really need a good basis there. We will fill it in as the interview goes on, but we need some idea if they own property. Do they own a car? Where do they work? How much do they make? We need to know that. Some people are reluctant to fill it out but really, they have to. It’s like if you go to a doctor, they are going to want to know what your problem is, why are you here? So that’s the questionnaire; 7 to 13, they have to fill that out.
The items on the questionnaire will lead to which chapter is most appropriate under the U.S. Bankruptcy Code. It will also provide an opportunity for the attorney to give advice. For example, if there is a student loan debt, that will allow the attorney to advise on the generally, non-dischargeable nature of such a debt. The same idea would apply for recent tax debt incurred within the prior three years.
