The bankruptcy questionnaire is the document that helps us acquire information.  So let’s go through this questionnaire with the understanding that this person is going to be like 75% of our clients; three out of four are going to be a Chapter 7. So we’re going to go section by section and kind of tell you what’s important.

The first section is obviously their name. The most important thing here and it comes up only about two times a year is that the person must have a valid Social Security number or TIN number. That doesn’t mean they have to be a citizen because you can get a Social Security number and not be a citizen. You can be a resident alien; the problem mostly lies with clients who do not speak English. They may have picked up someone else’s or bought someone else’s Social Security number. And it’s a common practice but most people who do that, don’t wind up filing bankruptcy for some reason. But if you know someone or they say that they don’t have one or they bought one, you can’t do the case. We just can’t be involved in that and it also sets them up for deportation. So again, two or three times a year it comes up.

We are also looking for the county that they live in.  That’s important because these cases are heard primarily in the county where the people live. So if they live in Cook County, everybody is going downtown to the federal building for a 341 meeting. If they live in Lake County, they are going up to Park City.
