Debts that are discharged in bankruptcy, it’s pretty easy to answer this question by answering what isn’t discharged in a bankruptcy. Chief among the debts that are not discharged include certain taxes, student loans, child support, toxic waste cleanup fines, government fines of any nature, such as moving violations or parking tickets; and then there are debts that by the court’s discretion after a trial, after a notice in a hearing, the court can hold are non-dischargeable. These are debts that are incurred by fraud. For example, going to a casino and spending $5,000.00 on a credit card within a month of filing the bankruptcy. It’s not an absolute that these kinds of debts will be held to be non-dischargeable, but the court in its discretion can determine that these debts were incurred with fraudulent intent and, therefore, should not be allowed a discharge.
