Coal Miner Alpha Natural Resources Files For Bankruptcy

Alpha Natural Resources Inc., one of the largest U.S. coal producers, filed for chapter 11 bankruptcy protection on Monday to cut its more than $3 billion debt load, The Wall Street Journal reported. The Bristol, Va., company will likely sell some of its best mines or turn them over to creditors.

In Rare Fight, Johnson & Wales Battles to Keep Tuition Money

Johnson & Wales University is fighting to keep $46,909 in tuition paid by a Connecticut couple for their daughter’s education against the demands of a bankruptcy court-official, who sued to get that money back.

The private, Rhode Island-based college has asked a bankruptcy judge to throw out the lawsuit that arose when Robert and Jean DeMauro filed for bankruptcy last year. A bankruptcy trustee who examined the DeMauros’ finances argued that the couple didn’t get any benefit from the tuition payments made from March 2011 to December 2013—their daughter did.

Caulkett: SCOTUS Hands BoA a Victory

The Supreme Court ruled unanimously in favor of Bank of America in Caulkett v. Bank of America. Basically the Court found itself bound by its previous decision in Dewsnup and didn't think that any of the distinctions presented (by yours truly among others) between Dewsnup and Caulkett were compelling.

Postpetition Wages Held by Chapter 13 Trustee Belong to Debtor Upon Conversion

In case you haven't seen it, the SCOTUS issued its unanimous opinion in Harris today, holding that postpetition wages held by the Chapter 13 trustee at the time a case is converted to Chapter 7 must be returned to the debtor.
