Understanding Electronic Discovery: Its Not Just About Protecting Your Client

Reading a recent Massachusetts Lawyers Weekly, I spotted an item in the Bar Discipline column that highlighted the dangers of not staying up to date with technology. A litigation attorney, let's call him Paul, failed to understand the rules governing electronic discovery, resulting in his client deleting electronic data and the Massachusetts Board of Bar Overseers issuing a public reprimand.

Credit Slips is please to welcome Professor Drew Dawson as a guest blogger. Drew is on the faculty at the University of Miami School of Law where he teaches the bankruptcy, commercial law, and the other sorts of course you would expect from someone at Credit Slips. He has published on collective bargaining agreements in bankruptcy and offshore bankruptcies. He is relatively newer voice in the academy, and we are happy to have him join us for a while.

Will the Fifth Circuit Clarify Pro-Snax?

For chapter 11 debtor's lawyers, Matter of Pro-Snax Distributors, Inc., 157 F.3d 414 (5th Cir. 1998) is like the sword of Damocles--constantly hanging over counsel's head and threatening to deny compensation when a case goes south.   While 11 U.S.C. Sec. 330(a)(3) makes results one of several factors to consider in awarding compensation, Pro-Snax makes "identifiable, tangible and material" results a pre-requisite to getting paid.

U.S. Bankruptcy Judge Morris Stern Dies

New Jersey Bankruptcy Judge Morris “Mickey” Stern, died Wednesday after battling cancer for more than a year. He was 72.

Judge Stern—called “Mickey” by colleagues—became a judge in 2001 in the U.S. Bankruptcy Court in Newark, N.J., where he presided over the bankruptcy cases for Bayonne Medical Center and for St. Mary’s Hospital in Passaic. He also handled the bankruptcy of Real Housewives star Teresa Giudice in 2010.
