I'm still digesting the opinion, but the obvious conclusion is that impressions from oral argument may be misleading. It also suggests that states that do not use chapter 9, have no ability to come up with a state law alternative. Its chapter 9 or nothing, which may suggest that the 10th Amendment is no longer a serious concern with regard to chapter 9.

On Monday in Manhattan, Sabine Oil & Gas Corp. and creditors it has fought for nearly a year in bankruptcy court will kick-off a seven-day showdown over the company’s multibillion-dollar restructuring plan.

During the hearing, which promises to be both lengthy and contentious, Sabine will face a group of creditors owed about $1.4 billion but slated to be repaid less than two cents on the dollar. Each side has agreed to limit itself to 24 hours of arguments and testimony spread out over at least seven days before U.S. Bankruptcy Court Judge Shelley Chapman.

Late night comedian John Oliver recently offered his unique and humorous take on the debt buying industry, noting that collection agencies are responsible for more lawsuits than any other type of plaintiff, and that many of these lawsuits claim money damages for zombie debt.  Zombie debt is debt that is not legally collectible because the statute of limitations has run.
