Courtroom Minutes. Time Hearing Held: 9:00 a.m.. Appearances: Eric Days for the Debtor(s); Jason Stark Assistant Attorney General and Rachel Obaldo for Texas Comptroller; Steve Statham for US Trustee by phone; Diane Bartek for Inter National Bank of Commerce in both cases. Both cases 18-10279 and 18-10280 were called simultaneously. After no objections by all parties, the motion for joint administration in Case # 18-10280 ECF #4 was granted, with main docket to be shown in 18-10279. All Parties agreed to an omnibus hearing with all matters considered simultaneously. Opening arguments by Mr. Days and Mr. Stark were heard, during which time both parties were questioned by the Court. After hearing arguments, the Debtor(s) motion to impose stay 33 was denied, rendering the Comptrollers motion to determine applicability of automatic stay 4 moot. The Court then took up the Comptrollers motion to dismiss 13. Exhibits were offered by Mr. Stark. Mr. Stark is to provide a CD of his Exhibits to the Clerks office by no later than 5:00 p.m. November 9, 2018. After no objections, the States Exhibits 1 through 14 were admitted. After hearing arguments, the motion to dismiss was continued to a final hearing on 1/4/2019 a 10:00 a.m. and a set of requirements were Ordered by the Court in a separate order. The status conference was held next. Court to issue Status Conference Order. The cash collateral motion 11 was then taken up. Ms. Bartek, Mr. Stark and Mr. Statham all announced no opposition to continued use of cash collateral. Debtor to amend the proposed budget to provide for $10,000 payment ordered by the Court at todays hearing and upload the amended budget within next 5 days. The Motion for cash collateral was granted pending submission of the amended budget.
