ORDER by Judge King : With regard to the Trustee's Expedited Motion Seeking to hold the Debtor in Contempt for Violation of the Court's August 31, 2026, Order, the Court will conduct an expedited hearing on September 15, 2026, at 9:00 AM, in Courtroom 3, 701 Broadway, Nashville TN 37203. The Trustee's Motion "presumes" that the Debtor's corporate representative, Andrew Boyd, was made aware of the August 31, 2026, Order, but there is no other allegation with regard to Andre E. Boyd's knowledge about the terms of the Order. The Certificate of Service attached to the Motion does not identify Mr. Boyd as an interested party who was served with notice of the Motion. Mr. Boyd is not listed on the mailing matrix, and it is unclear whether he is personally represented by an attorney. If the Trustee intends to proceed with the sanctions motion, Mr. Boyd must be given prior notice of any sanctions if such are sought against him. The Trustee's Motion seeks sanctions only against the corporate debtor but asks the Court to compel Mr. Boyd's attendance without any assurance that Mr. Boyd was given notice of the Order or the Expedited Motion. If the Trustee can provide proof that Mr. Boyd was given ample notice of the hearing and any potential sanctions against him as the corporate representative, then the Court will conduct the hearing as scheduled.
