ORDER AND NOTICE: Upon review of the Chapter 7 Trustees urgent motion for modification of the automatic stay and adequate protection (Docket No. 70), the court orders the following:(1) a modification of the automatic stay is GRANTED to permit the case identified as Carolina Properties, Inc. v Carvin School Inc, and others, Civil Case No. CA2023CV01733, pending before the Puerto Rico Court of the First Instance of Carolina, for the limited purposes of allowing CPI to continue the substitution of the promissory notes until the point of judgment; any matters related to the amount of the claim and its payment, shall be channeled through the Bankruptcy Court and satisfied pursuant to distributions approved in the Motion for Sale of Property, which already addresses the secured amount allocated to the CPI;(2) The hearing scheduled for July 21, 2026, regarding the Motion for Relief from Stay is continued to September 15, 2026, at 1:30 via Microsoft Teams, and the Adversary Proceeding is held in abeyance until the same date, September 15, 2026; (3) The Trustee is ordered to retain the funds intended for Creditor CPI with the liens attaching to the proceeds pursuant to Section 363(f) of the Bankruptcy Code pending resolution of the substitution of the missing promissory notes; and (4) In light of the above, the need for consignment of funds with the bankruptcy court with a replacement lien in favor of CPI is now moot..
