Minutes of Proceeding/Contested Matters: Debtor's principal has been criminally indicted. Free on bond. Debtor corporation operates and does business at several store locations. Debtor alleges in argument that sales receipts have been deposited in DIP account. However, the MOR's show differently. MOR's belatedly filed last night, and February 2016 still not filed. U.S.T. questions feasibility and reasons for filing, not a safe haven for persons being indicted. Debtor's main asset is essentially the going concern value. ORDER: It is uncontested that the debtor has belatedly filed the monthly reports of operation and the February 2016 report is still due. Such a failure constitutes cause for dismissal under §1112(b). On the other hand, the debtor has failed to show that there are unusual circumstances to show that dismissal is not in the best interest of creditors.
