Minutes of confirmation: Access minute for further details on court proceedings. ORDER: Based on the foregoing and for the reasons stated in open court, the court grants the objections to confirmation filed by Sucesin J. Serralls (Dkt. # 34) and the Trustee (Dkt. # 56) and denies confirmation of the Chapter 12 Plan filed at Dkt. # 52. The court also grants the motion to dismiss filed by Sucesin J. Serralls at Dkt. # 34 as joined by the Trustee at Dkt. # 46 and in open court. The court finds cause to dismiss pursuant to 11 U.S.C. §§ 1208(c)(1) and (5) for unreasonable delay that is prejudicial to creditors and upon the denial of confirmation of a plan and denial of a request [] for additional time for filing another plan or a modification of a plan. The court notes that it must conclude the confirmation hearing within forty-five (45) days after the filing of a Chapter 12 Plan pursuant to 11 U.S.C. § 1224, which elapse next Sunday, June 23, 2024. The court also notes that there is cause to dismiss under 11 U.S.C. § 1208(c)(3) for failure to file a Plan timely within the ninety-day (90) deadline provided by 11 U.S.C. § 1221 as raised by creditors and the Trustee.
