TEXT ORDER: And Now, this 9th Day of April, 2024 it is hereby Ordered that: Upon preliminary review of the Small Business Debtors Chapter 11 Plan of Reorganization dated April 8, 2024 [Dkt. No. 69], the Court finds the plan does not comply with 11 U.S.C. 1190(1)(C) by containing projections with respect to the ability of the debtor to make payments under the proposed plan of reorganization. Though the plan references financial projections on Schedule 3.2 (see section 3.2 of the Plan), the documents seemingly attached as Schedule 3.2 are historical financials. Moreover, the historical financials are also incomplete: they reference the time period of January December 2023, yet only cover the first seven months of the year. Because the Code calls for projections covering the plan term, the Court finds the incomplete historical financials absent further explanation to be non-compliant. The Debtor is hereby granted 14 days leave to cure this defect with an amended plan. If a fully-compliant plan is filed on or before April 22, 2024, the Court may issue an order scheduling a confirmation hearing and setting deadlines for parties to cast ballots or file objections to confirmation.
