TEXT ORDER: On December 17, 2020, a hearing was conducted on the Court's Order to Show Cause Why the Case Should Not be Converted or Dismissed [Dkt. No. 73] ("Order to Show Cause"). It is hereby ORDERED, ADJUDGED, and DECREED that the Order to Show Cause is CONCLUDED. After considering the issues raised in the Order to Show Cause, the Court finds cause to dismiss the case without prejudice as the Debtor is unable to propose a feasible plan of reorganization, any liquidation would only inure to the benefit of a singular secured creditor, and in the absence of any benefit to any other creditors or parties in interest, the Court finds it is in the best interest of the bankruptcy estate to dismiss the case. To the extent the Debtor and First Commonwealth Bank agree on the terms of a dismissal order, a proposed order shall be submitted under Certification of Counsel on or before December 31, 2020. In the absence of any timely submitted proposed order, the Court will dismiss the case on its own order. This text-only entry constitutes the Court's order and notice on this matter. Judge Taddonio Signed on 12/17/2020. (RE: related document(s): [73] Order Scheduling Hearing). (jhel)
