Status conference held. Upon the Court's inquiry, counsel advised that (1) debtor has been working with the primary lender but has been unable to come up with a plan; (2) debtor has been using cash collateral without formal written consent of interested creditors and without a Court order; and (3) debtor has made one post-petition interest payment to First Bank & Trust Company on account of a pre-petition debt without Court's approval. Court expressed its concern regarding the lack of progress in this case that was filed in July. The Court further advised debtor that the US Trustee's motion to dismiss, which is currently set for hearing on 1/15/20 at 9:30 a.m., is based on valid grounds, especially in light of what the Court learned today. Therefore, in order to prevent dismissal, debtor, at a minimum, should have a disclosure statement that is set for hearing and a confirmable plan on file when they file their response to the US Trustee's pending motion to dismiss.
