Hearing held on proposed scheduling order related to the pending objections to Applications for Compensation ECF #443 and #444. Court orders that the Committee provide a list of Rule 30(b)(6) topics to Counsel for Lewis Rice by the close of business on August 28; Counsel for Lewis Rice to provide dates for a Rule 30(b)(6) deposition by September 4. If Lewis Rice has objections to any of the Rule 30(b)(6) topics, or if any other party has objections to Rule 30(b)(6) topics related to any of the other Rule 30(b)(6) depositions, the Court will hold a status hearing on September 2 at 1:00 p.m. by phone to determine the appropriateness of the topics; otherwise, Counsel for Lewis Rice is to provide the dates for the Lewis Rice Rule 30(b)(6) deposition to the parties by September 4. If the parties are in agreement, the September 2 status conference will be cancelled, with a final agreed scheduling order due within 7 days thereafter, or by September 9. Status hearing dates to be held by phone included in the proposed scheduling order are: September 14 at 9:00 a.m.; October 14 at 1:30 p.m.; and November 23 at 1:30 p.m. Parties to notify the courtroom deputy by email in advance if the September 14 status hearing is not needed. The Court will schedule other hearings as needed based on what may be filed. Court also rules that the depositions of Focus Management witnesses shall occur live in the offices of Counsel for Focus Management in Kansas City and that depositions of Lewis Rice lawyers shall occur either in Lewis Rices Kansas City office or in Counsel for Lewis Rices Kansas City office, unless otherwise agreed to by all parties (applicants and all objecting parties). Lewis Rice is not entitled at this time to take the depositions of individual members of the Creditors Committee but after taking the Rule 30(b)(6) deposition of the Committee, Lewis Rice may seek relief from the Court to take further depositions upon a showing of appropriate need under Rule 26. All other rulings are as set forth on the record. Other scheduling dates and deadlines as set forth in the parties email to the court are approved. Absent other issues, a final scheduling order shall be due by September 9. ERO - EC
