Courtroom Minute Sheet (RDB), Ruling: Statements of counsel are heard. A breech in the contract has been determined. Sale is scheduled for closing on June 15th. The payment of rent for the months of June and July, for utilities and for county taxes are all to be paid from the proceeds of the sale. In accordance with the non compliance of the prior order of the Court, the debtor is ordered to pay an additional $10,000.00 to landlord at closing. The landlord is to submit a legal fee statement which will also be paid atclosing. This makes the total due to landlord of $30,000.00 instead of $20,000.00 plus legal fees and expenses up to and including this hearing. If the sale does not proceed on June 15th the Order for Immediate Possession will be approved by the Court. Additional orders of the Court include a sworn statement to be provided with respect to the cranes, if inspection is needed access will be provided. Costs of any inspection of the cranes will come from sale proceeds. Also the key to the yard padlock will be provided.
