ORDER DENYING MOTION TO EXTEND AUTOMATIC STAY AS MOOT AND CONFIRMING EXISTENCE OF AUTOMATIC STAY. On July 1, 2026, JSM Properties, LLC (the “Debtor”) filed a Motion to Extend the Automatic Stay (the “Motion to Extend,” ECF No. 23) and a Motion to Expedite Hearing on the Motion to Extend (ECF No. 24). A hearing on the Motion to Extend was held on July 7, 2026. No objections to the Motion to Extend were filed and no party in interest appeared at the hearing to oppose the Motion to Extend. During the hearing, the Debtor’s counsel informed the Court that a party who has an interest in the Debtor’s real property located in Georgia has taken steps to foreclose on the real property after the Debtor filed this case. Because the Motion to Extend seeks relief under 11 U.S.C. § 362(c)(3), which applies only in cases filed by individuals and not corporate entities, the relief requested under § 362(c)(3) cannot be granted. However, upon the filing of a petition, 11 U.S.C. § 362(a) operates as a stay applicable to all entities of, among other things, the commencement or continuation of the issuance or employment of process, a judicial, administrative, or other action or proceeding against the debtor or property of the debtor’s estate. Accordingly, it is hereby

ORDERED: The Motion to Extend is denied as moot. The automatic stay provided in 11 U.S.C. § 362(a) went into effect when the Debtor filed this Chapter 11 case on June 1, 2026, and shall remain in effect pursuant to 11 U.S.C. § 362(c)(1) and (c)(2) until the real property is no longer property of the estate or the case is closed or dismissed, or until a party in interest seeks and obtains relief from the automatic stay in accordance with 11 U.S.C. § 362(d).
