DOCKET TEXT ORDER (no separate order issued:) On August 25, 2026, Debtor filed an Ex Parte Application to Reset Hearing on Motion for Use of Cash Collateral (Dkt. 31, "Application"). While the filer did not link the Application to an underlying motion, the Court interprets the request to refer to Docket 13: Motion to Use Cash Collateral Filed by Debtor J. McCabe Plumbing, Inc., and the related attachments (collectively, "Motion"). The Motion has drawn a response from U.A. Local 393 Health and Welfare Trust Fund, et al. (Dkt. 27) and an Objection from the United States Trustee (Dkt. 28). The Application is defective for several reasons. First, it does not comply with Bankruptcy Local Rule 9006-1(c)(1). To the extent counsel intends to incorporate the information set forth in the earlier Application for Order Shortening Time re Initial Hearing on Motion for Use of Cash Collateral (Dkt. 14), the Application should say as much. Additionally, the Court would benefit from an updated explanation. Second, the Application does not comply with Bankruptcy Local Rule 9006-1(c)(4), including the Application is silent regarding efforts to speak with counsel for the responding creditor and the United States Trustee. Third, it appears counsel has not reviewed section 4.B. of Judge Porters Practices and Procedures, which specifically addresses how to obtain a date and time for a hearing on shortened time outside the available dates posted on the Open Calendar.
