DOCKET TEXT ORDER (no separate order issued:) This case came before the court on October 1, 2026, for a hearing to consider tentative approval of the disclosures set forth in Debtor 40th Street Development LLC's Combined Plan/DS dated August 10, 2026 (Dkt. 68; the "Disclosures"). Appearances were as noted on the record. For the reasons stated on the record, the court orders as follows: (1) Debtor's request for approval of the Disclosures is hereby denied. (2) On December 10, 2026 at 10:00 a.m., the court will convene a status conference. You may appear at the December 10 status conference in-person or by Zoom. The court has carefully reviewed the Application, supporting pleadings and exhibits, Notice of Hearing (Dkt. 80; the "NOH"), and Certificate of Service (Dkt. 80). Based on that analysis, the court finds and concludes that the Application and NOH were properly served and that all necessary parties have received adequate notice of their opportunity to objection to the fees and expenses requested in the Application. Pursuant to B.L.R. 9014-1(c)(1), objections to the Application were due no later than September 24, 2026; none have been filed. The court further finds and concludes that the fees and expenses requested in the Application are reasonable, and that the services rendered by the Applicant were necessary to the efficient administration of this case.
