DOCKET TEXT ORDER (no separate order issued:) At the hearing tomorrow on Confirmation of the Plan (Dkt 1302), and in particular in view of the Objections of the United States Trustee (Dkts 1289 & 1324), counsel for the Debtor and the Committee should be prepared to explain why the Injunction (Art. XI, D) is even necessary. Bankruptcy Code sections 105 and 362 are fully operative, the No Discharge provision (Art. XI, A) works well and the Exculpation provisions (Art. XI, C) seem more than adequate. This liquidating Plan, with its four complex stipulations and agreements in place, now resembles a Chapter 7 where there would not be an injunction in place. Additional belts and suspenders of a controversial Injunction seem neither necessary nor appropriate. (Montali, Dennis)
