(no separate order issued:) This case came before the court on June 18, 2026 for a continued hearing to consider confirmation of Debtor Atherton Trail LLC's Combined Plan/Disclosure Statement dated March 14, 2026 (Dkt. 49; the "Plan") and a continued hearing on the court's Order to Show Cause (Dkt. 36; the "OSC"). Appearances were as noted on the record. For the reasons stated on the record, the court orders as follows: (1) No later than June 25, 2026, Debtor shall file a declaration that: (a) details (i) all payments required under the Plan between confirmation and August 31, 2026 (the "Relevant Period"); (ii) all ordinary course business expenses that will come due within the Relevant Period; and (iii) all adequate protection payments to EF Mortgage LLC that will come due during the Relevant Period; and (b) introduces and authenticates documentary proof that Debtor's Debtor-in-Possession account (Premier Bank XXX-9980) contains funds sufficient to cover all such payments. (2) If Debtor files such a declaration, Debtor's counsel also shall upload a confirmation order that reflects the signature of counsel for EF Mortgage LLC, approving the confirmation order as to its form. (3) If the Debtor timely files a declaration that complies with this order, the court will confirm the Plan and vacate the OSC. (4) If Debtor does not timely file the declaration required by this order, or if such declaration does not comply with this order, the court will enter an order converting this case to one under Chapter 7 without further notice or hearing.
