DOCKET TEXT ORDER (no separate order issued:) This case is scheduled to come before the court on December 18, 2025 for a hearing on, among other things, Debtor Dynasty Song LLC's Motion to Dismiss (Dkt. 74; the "Motion"). The Motion requests dismissal of the case because Debtor's affiliate (Dynasty Tang LLC), which is a debtor-in-possession in another case (25-30481) plans to sell its real property, which will pay off most of the debt that is cross-collateralized by Dynasty Song's only asset: real property located at 260 San Marco Avenue, San Bruno, CA (the "Property"). The Motion also represents that Dynasty Song is in the process of finalizing a modification of the loan secured by a first lien on its Property. According to the Motion, once the second lien debt has been paid down significantly and once the modification of the first lien debt has been completed, Dynasty Song will have fulfilled the purpose of this case, and reorganization under the Bankruptcy Code will make no further economic or practical sense. The court agrees, but must note that the Motion makes no mention of the secured claim filed by the San Mateo County Tax Collector (Proof of Claim 1-1) on October 10, 2025 in the amount of $79,890.32. Dynasty Song scheduled no unsecured debts and no such claims were timely filed. Pursuant to B.L.R. 9014-1(c)(2), opposition to the Motion was due no later than December 11, 2025; none has been filed. The court will grant the unopposed Motion, as it believes that all secured creditors have the wherewithal to protect their respective interests. Accordingly, the court orders as follows: (1) The Motion will be granted; (2) Dynasty Song's counsel shall promptly upload an order consistent with the Motion; and (3) All hearings set for December 18, 2025 are hereby vacated.
