The sale is contingent upon Bankruptcy Court approval and is subject to overbidding (a live auction) at the sale hearing. Overbidding will only occur at the sale if (a) the Bankruptcy Court Trustee accepts an offer to purchase the lien rights and (b) one or more qualified overbids are received not later than 2 days before the sale hearing. $150,000 EMD Cashier’s Check to be deposited with Bankruptcy Court Trustee. The lien rights will be sold on an “as is, where is” basis with no representations or warranties by the Bankruptcy Court Trustee whatsoever.
